1. Who we are

This website, sofang.com.au, is operated by SOFANG PTY LTD (ABN 80 649 963 673) (“Sofang”, “we”, “us” or “our”). Our address is Suite 903, Level 9, 67 Albert Avenue, Chatswood, NSW 2067, Australia.

Sofang operates a property information, advertising and enquiry-connection platform. We are not a real estate agent, buyer’s agent, conveyancer, valuer, lender, mortgage broker, lawyer, accountant, tax adviser, financial adviser or investment adviser. Any regulated professional service is provided only by a separately identified, appropriately licensed provider under its own written engagement; Sofang is not that provider.

This Privacy Policy explains how we collect, hold, use and disclose personal information when you use our website and related services. We handle personal information in accordance with this Policy and applicable Australian privacy law, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.

2. Personal information we collect

Depending on how you interact with Sofang, we may collect:

  • your name, email address, telephone number, WeChat identifier and other contact details;
  • your property goals, preferred locations, budget range, timing, finance-readiness and enquiry messages;
  • account and authentication information;
  • agent, agency, property owner, advertiser or business profile information;
  • property listing information, photographs and other content you submit;
  • correspondence, support requests, complaints and communication preferences; and
  • technical information such as IP address, browser and device information, referring pages, pages viewed, timestamps, cookies and similar technologies.

Please do not provide sensitive information, or personal information about another person, unless it is reasonably necessary and you are authorised to provide it.

3. How we collect personal information

We generally collect personal information directly from you when you create or update an account, submit or manage a listing, send a property or service enquiry, contact us, or separately subscribe to communications.

We may also receive information from a listing publisher, advertiser, agency, property owner, service provider or another person where this is authorised or reasonably necessary. Technical information may be collected automatically through website logs, cookies and similar technologies.

4. Why we use personal information

We may use personal information to:

  • create and administer accounts, listings and profiles;
  • provide search, enquiry and other website functions;
  • respond to questions, support requests and complaints;
  • send an enquiry to an identified recipient, or make a relevant referral where you have chosen to consent;
  • detect fraud, misuse, security incidents and unlawful activity;
  • moderate content and enforce our Terms of Use;
  • maintain, analyse and improve the website;
  • comply with legal obligations; and
  • send marketing communications where we have separate consent or are otherwise permitted by law.

5. Enquiries and referrals

A general property-needs form addressed to Sofang is received by Sofang. We will not transfer that enquiry and your contact details to a property publisher, advertiser or service provider unless the form clearly explains the proposed transfer and you choose to consent, or another lawful basis applies.

If a form is clearly presented as a direct enquiry to an identified property publisher, advertiser or service provider, the information you submit may be sent to that recipient so it can respond. That recipient is responsible for its own handling of your information, and you should review its privacy policy.

We may disclose personal information to suppliers that help us provide hosting, email, security, analytics, customer support and professional services, but only to the extent reasonably necessary for those services. We may also disclose information where required or authorised by law, or in connection with a genuine business sale or restructuring subject to appropriate safeguards.

6. Direct marketing

Submitting a property enquiry does not, by itself, subscribe you to unrelated marketing. We send commercial electronic messages only where we have consent or are otherwise permitted by law. Marketing messages will identify the sender and provide a clear way to unsubscribe. You may withdraw marketing consent at any time by using the unsubscribe facility or contacting us.

7. Cookies, analytics and advertising technology

We use cookies and similar technologies for website operation, security and preferences. Where enabled, we may also use measurement or advertising technologies supplied by providers such as Google and Meta to understand website use, measure campaigns and improve our services. These providers may collect device, browser, IP address, event and cookie information under their own privacy terms.

You can control cookies through your browser settings, although disabling necessary cookies may affect website functions. Browser or platform privacy controls may also limit some measurement and advertising technologies.

8. Overseas processing

Some of our technology and service providers may store or process personal information outside Australia. Based on the providers currently used or capable of being enabled on the website, likely locations include Australia, the United States and other countries in which those providers operate. Where Australian privacy law requires it, we take reasonable steps in relation to overseas recipients. Overseas recipients may be subject to different privacy laws.

9. Payments

Sofang does not currently offer an enabled online payment gateway through this website. If we introduce a paid advertising or other paid service, the price, term and payment provider will be shown before purchase. Payment providers may collect and process payment details under their own privacy policies. We will update this Policy if our payment practices materially change.

10. Retention and security

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to resolve disputes, maintain security records, or meet legal and record-keeping obligations. When information is no longer required, we take reasonable steps to delete or de-identify it, subject to lawful backup and archival requirements.

We take reasonable administrative, technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No internet service is completely secure, so please contact us promptly if you believe your account or information has been compromised.

11. Access and correction

You may ask for access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact our Privacy Officer using the details below. We may need to verify your identity. We will respond within a reasonable period, generally within 30 calendar days. If the law permits or requires us to refuse a request, we will explain the reason and available complaint options where required.

12. Privacy complaints

If you believe we have mishandled your personal information, please send our Privacy Officer your name and contact details, a description of what happened and the outcome you are seeking. We will acknowledge, investigate and respond within a reasonable period, generally within 30 days.

If the Privacy Act applies to the matter and you are not satisfied with our response, or we have not responded within a reasonable period, you may contact the Office of the Australian Information Commissioner at oaic.gov.au.

13. Third-party websites

Our website may link to third-party websites. Their privacy practices are governed by their own policies, and we encourage you to review those policies.
